Welcome to DiyDate! These Terms of Service (“Terms”) govern your use of our mobile application and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account on DiyDate. By creating an account, you represent and warrant that you are 18 or older and that you have never been convicted of a felony or a similar crime, a sex crime, or any crime involving violence.

2. Your Account

  • Account Creation: To use the Service, you must register for an account using your email address, phone number, or social media login. You agree to provide accurate and truthful information and to keep it updated.
  • Account Security: You are responsible for keeping your account login credentials confidential. You are solely responsible for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately.
  • Non-Commercial Use: The Service is for personal, non-commercial use only. You may not use the Service to promote or sell products, services, or events without our express written consent.

3. User Conduct

You agree to use the Service in a respectful and lawful manner. You will not:

  • Harass or Threaten: Harass, stalk, intimidate, or threaten other users. This includes sending unwanted messages, making threats of violence, or engaging in any form of cyberbullying.
  • Post Prohibited Content: Post, upload, or share any content that is:
    • Illegal: In violation of any law or regulation.
    • Hateful or Discriminatory: Promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.
    • Defamatory or Libelous: Is false or misleading.
    • Sexually Explicit: Contains nudity, pornography, or is otherwise obscene.
    • Violent: Promotes violence, terrorism, or illegal acts.
    • Infringing: Violates the intellectual property rights of others.
  • Misrepresent Yourself: Impersonate any person or entity or post false information about yourself.
  • Engage in Prohibited Activities:
    • Use the Service for any illegal purpose.
    • Use bots, scripts, or other automated means to access the Service or interact with other users.
    • Spam, solicit, or send mass messages to other users.
    • Interfere with or disrupt the Service or the servers connected to the Service.

We reserve the right to investigate and/or terminate your account without a refund if you violate any of these rules.

4. Content and Licenses

  • Your Content: You are solely responsible for the content you post on the Service, including your profile information, photos, messages, and any other materials. By posting content, you represent that you have all necessary rights and permissions to do so.
  • Our License to You: DiyDate LLC grants you a limited, non-exclusive, revocable, and non-transferable license to access and use the Service for your personal, non-commercial use.
  • Your License to Us: By posting content on the Service, you grant DiyDate LLC a worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, copy, modify, distribute, publish, and process your content, including for the purpose of operating, developing, and promoting the Service.

5. Disclaimers and Limitation of Liability

  • No Guarantees: The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that your use of the Service will be secure, uninterrupted, or error-free. We do not make any guarantees as to the number of matches you will receive, nor do we verify the identity of any users.
  • Assumption of Risk: You assume all risk when using the Service and meeting other users. We are not responsible for the actions of users, and we advise you to use caution when interacting with others, especially if you decide to meet in person.
  • Limitation of Liability: To the fullest extent permitted by law, in no event shall DiyDate LLC, its affiliates, employees, or partners be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

6. Termination

You may terminate your account at any time, for any reason, by following the instructions in the app. We may terminate or suspend your account at any time, with or without notice, if we believe you have violated these Terms.

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of Nevada, without regard to its conflict of law principles. Any dispute arising from these Terms will be resolved through arbitration in Nevada or in small claims court, as appropriate.

8. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on the Service. Your continued use of the Service after a change indicates your acceptance of the updated Terms.
